Please read these Terms of Service ("Terms") carefully before using the FortemFI website, mobile application, or financial wellness platform (collectively, the "Services") operated by FortemFi, Inc. ("FortemFI," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

1. Eligibility

You must be at least 18 years of age to use our Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of a public sector agency or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

To access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@fortemfi.com of any unauthorized use of your account.

3. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates applicable federal, state, or local laws or regulations
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity
  • Attempt to gain unauthorized access to any portion of the Services or related systems
  • Transmit any unsolicited or unauthorized advertising, promotional materials, or spam
  • Upload or transmit any viruses, malware, or other malicious code
  • Scrape, crawl, or otherwise extract data from the Services without our prior written consent
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or disassemble any portion of the Services

4. Financial Information Disclaimer

The Services provide financial wellness tools, educational content, and AI-generated recommendations for informational purposes only. FortemFI is not a registered investment adviser, broker-dealer, financial planner, or tax advisor. Nothing on the Services constitutes financial, investment, legal, or tax advice. You should consult a qualified financial professional before making any financial decisions.

Retirement projections, savings estimates, and benchmark comparisons are provided as general guidance only and are not guarantees of future results. Actual outcomes will vary based on individual circumstances.

5. Subscription Plans and Payments

Certain features of the Services are available only through a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are stated in U.S. dollars and are exclusive of applicable taxes unless otherwise noted.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us at support@fortemfi.com. Refunds are not provided for partial subscription periods except where required by applicable law.

We reserve the right to change our pricing at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

6. Intellectual Property

The Services and all content, features, and functionality — including but not limited to text, graphics, logos, icons, software, and data compilations — are owned by FortemFI or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes. You may not reproduce, distribute, modify, or create derivative works of any content from the Services without our prior written consent.

7. User Content

You retain ownership of any financial data, documents, or other content you upload or submit to the Services ("User Content"). By submitting User Content, you grant FortemFI a non-exclusive, worldwide, royalty-free license to use, process, and store your User Content solely to provide and improve the Services.

You represent and warrant that you have all rights necessary to submit User Content and that your User Content does not violate any third-party rights or applicable laws.

8. Third-Party Integrations

The Services may integrate with third-party platforms such as HRIS systems, payroll providers, and credit bureaus. Your use of any third-party service is governed by that party's own terms and privacy policies. FortemFI is not responsible for the practices, content, or availability of any third-party services.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORTEMFI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FORTEMFI IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless FortemFI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state in which FortemFi, Inc. is incorporated, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
